The Kyiv Court of Appeal has overturned the sentence passed in April on Valery Ivashchenko, former Acting Minister of Defence in Yulia Tymoshenko’s government. Mr Ivashchenko had been convicted on 12 April in the Pechersky District Court of “abusing his position”  in November 2009 while Acting Minister of Defence by signing a plan to sell the Feodosia Marine Engineering Works  The sentence then was for five years imprisonment, this including the near two years that he had already spent in custody.

The court on Tuesday freed Ivashchenko from serving the sentence with a probation period of one year. It prohibited him from leaving the country without informing the Penitentiary Service and ordered him to report to them periodically.  The other person convicted in the case also received a suspended sentence.  The court's sudden leniency is, according to the prosecutor, linked with Mr Ivashchenko's having accepted partial guiilt. 

 Former Polish President Aleksander Kwaśmiewski, now one of the MEPs carrying out monitoring of the prosecutions of members of Yulia Tymoshenko’s government attended the hearing on Tuesday.

Valery Ivashchenko was arrested in August 2010 and charged with having, in November 2009 while Acting Minister of Defence abused his position by signing a plan to sell the Feodosia Marine Engineering Works which was property of the Ministry of Defence.  More details can be found in the Second Preliminary Report by the Danish Helsinki Committee on Human Rights, where Valery Ivashchenko’s case is one of those examined.
